Aliante occupies roughly 1,900 acres at the northwestern edge of North Las Vegas, and almost none of it existed before 2002. The federal government auctioned the land in May 2001, construction started in August 2002, and the community held its grand opening the following May. That compressed timeline shapes nearly every legal question the neighborhood produces: the homes are young, the covenants are uniform, and the underlying paperwork is recent enough that it can usually still be located.

A Neighborhood Built in a Single Cycle

Most Aliante rooftops went up between 2002 and the end of the decade. Homes finished in that window sit squarely inside the framework Nevada uses for residential construction claims. A constructional defect is defined at NRS 40.615 as a deficiency in materials or workmanship, or both, that fails to meet applicable standards or the quality level a property owner reasonably expects.

Two timing rules govern. NRS 11.202 sets an outer limit of 10 years from substantial completion for most actions arising from the design or construction of an improvement to real property, and NRS 11.2055 governs how that completion date is fixed. Separately, NRS 40.600 through 40.695 require a claimant to send the contractor written notice describing the alleged deficiency, and to allow inspection and an opportunity to repair, before the action proceeds. Skipping that step is a common reason a claim stalls at the threshold. A litigation review normally begins by pinning down the completion date, because everything else counts from there.

Covenants, the Association, and Sun City Aliante

Aliante is governed as a common-interest community under NRS Chapter 116, which applies to common-interest communities created in this state. Sun City Aliante, the Del Webb age-restricted portion completed in March 2003, carries additional recorded covenants tied to its 55-and-older restriction. Lots bordering the Aliante Golf Club, an 18-hole public course that opened in December 2003, frequently carry setback and view provisions that buyers overlook at closing.

Before suing over the meaning or enforcement of those covenants, NRS 38.310 generally requires the claim first be submitted to mediation. NRS 38.300(3) carves out certain matters: an action in equity for injunctive relief in which there is an immediate threat of irreparable harm, and an action relating to the title to residential property. The exclusion is limited to residential property, so it is narrower than it is often assumed to be. NRS 116.31031 governs an executive board's power to impose fines for violations of the governing documents and the procedure it must follow first. A fine imposed without that procedure is vulnerable.

Where Aliante Traffic Concentrates

Aliante funnels onto a short list of arterials. Aliante Parkway runs north and south through the community; Deer Springs Way, Elkhorn Road, Ann Road, and Centennial Parkway cross it; and Simmons Street together with the CC-215 Las Vegas Beltway carries traffic in and out at the southern edge. The Beltway interchanges and the wide signalized intersections along Aliante Parkway are where higher speeds and heavy turning movements meet.

Nevada allows two years to bring an action for injuries to a person, or for a death caused by the wrongful act or neglect of another, under NRS 11.190(4)(e). Nevada also applies comparative negligence under NRS 41.141, which measures a claimant's own negligence against the negligence or gross negligence of the parties to the action against whom recovery is sought, so a claimant's share of fault reduces recovery and past a point bars it. Those two rules drive most early decisions in an auto accident matter, and they carry more weight where injuries are catastrophic.

The Commercial Spine

Aliante's commercial activity clusters along Aliante Parkway. Aliante Casino + Hotel + Spa, at 7300 North Aliante Parkway, opened in 2008 as Aliante Station with a 211-room hotel and roughly 125,000 square feet of casino floor near Simmons Street and the Beltway. The community's first neighborhood shopping center, anchored by a grocery store, was completed in the fall of 2005.

A resort of that scale pulls licensing, vendor, and employment questions into the neighborhood's orbit. Nevada regulates gaming and licensing through an administrative process that runs on a separate track from the civil courts, with its own filing standards and review, and our gaming and administrative law practice addresses that track. Smaller operators along the corridor more often need help with business formation or a breach of contract claim against a supplier, contractor, or tenant.

Which Court Hears an Aliante Case

Aliante lies inside the City of North Las Vegas, incorporated on May 1, 1946 and a separate municipality from the City of Las Vegas. Lower-value civil matters, evictions, small claims, and state-law misdemeanor and traffic offenses arising in the township go to the North Las Vegas Justice Court at 2428 North Martin L. King Boulevard, North Las Vegas, Nevada 89032. A citation charging a violation of a City of North Las Vegas ordinance goes instead to the North Las Vegas Municipal Court, whose jurisdiction under NRS 5.050 runs to violations of the city's own ordinances rather than to state statutes. Larger civil actions are filed with the Eighth Judicial District Court at the Regional Justice Center, 200 Lewis Avenue in downtown Las Vegas. Deeds, plat maps, and the recorded covenants for each Aliante village are on file with the Clark County Recorder.

Possibly, but the answer depends on dates rather than on the age of the neighborhood.
