Unincorporated, and Why That Changes the Answer

Summerlin as a whole was developed by the Howard Hughes organization on land assembled beginning in 1952, and takes its name from Jean Amelia Summerlin. Summerlin Parkway, the six-lane connector running from Rainbow Boulevard to Town Center Drive, opened in 1990 and tied the plan into U.S. Route 95. But the portion south of Charleston Boulevard was never annexed into the City of Las Vegas.

For an owner, that means Clark County handles zoning, building permits, business licensing, and code enforcement here. A citation, a variance request, or a neighbor complaint follows county procedure and county deadlines. Getting the forum wrong is expensive: an appeal filed with a city department that has no jurisdiction may preserve nothing, and the underlying deadline keeps running while it sits.

Village Covenants and the Mediation Requirement

Summerlin South is organized into villages, each with its own recorded covenants, conditions and restrictions and its own architectural review process. The Ridges, a guard-gated village inside Summerlin South, sits at the upper end of that structure. Design review over rooflines, exterior color, landscape palettes, and grading is an active part of village governance here, in part because the plan protects sightlines toward Red Rock Canyon.

These are common-interest communities under NRS Chapter 116. NRS 38.310 generally bars a civil action based on a claim relating to the interpretation, application, or enforcement of the governing documents unless the claim has first been submitted to mediation.
